Almost, fcc communications law, amendments to communications act of 1934.  This
one comes up a lot within "monitoring"
groups, such as shortwave listeners, scanner listeners, etc.

MOst times it's not going to be noticed, unless you commit
another "crime" alogn with it, let's say the guy orders the
cool new thing via ship to shore telephone, you're listening on your favorite
shortwave receiver and hear him give a
credit card number.  Besides being prosecuted for utilizing
that purloined cc number they might bring in federal stuff
from the communications act.

LEt's take a real world example.  i know you see those
little weekly journals I post to the listserv we're both on
for the maritime mobile service net.

The hams aboard vessels are, for the most part, asking us to post their
positions and some weather data for the weather
service, and their friends at home on the web.  That journal shows readers
their last posted position report, etc. etc.
Youv'e also noted I'm sure the 'heard list" section at the
end, which is even more relevant to this discussion, because those who post to
shiptrak know that anybody with a browser
can look 'em up and see waht was posted there by one of us
on their behalf.

Even the "heard list" section is within bounds, the guy was
heard on a net, and might be posting his position via the
web via internet by radio, so we don't post it, or, in port
planning to depart in a couple days.

But, now were i to follow him and another station off
frequency and post notes on the conversation the skipper had with his sister
via phone patch then I'd be badly breaking
the law according to the amendments to the communications
act of 1934, ecpa etcetera.

But, the way that law was written gave people a loophole
which enabled them to listen to cellular phones, when they
were analog, until some of the later versions of ecpa.
That's why that dc to daylight receiver you bought since the early '90's has
the cellular phone bands blocked out if
you're in the U.s.

Those are the same amendments that protect you and me as
sysops, if we treat ourselves as common carriers, and don't
provide ourselves any facility to read in transit netmail,
etc. etc.  IF we didn't see it, then we have no obligation
to report it if there *is* criminal activity.  See past
exchanges between us this echo over last couple of days on
this one <grin>.
But, for a quick and dirty example ...

I use netmail or email to arrange a meet with my connection. IF you have the
capability to read private mails, and can do so, then you'd be obligated to
become a narc.  But, if you
have no facility to do so, then you aren't culpable as a co
conspirator.

Which is why MIke GOdwin and others were urging bbs sysops
in the early '90's to forget about all those silly
disclaimers re privacy, etc.
But then, I warn a point or other downlink connecting up
that private mail passing through here is just that, passing through.  IT does
not appear in my message bases except very briefly while tossing and scanning,
as soon as it's packed
for the next hop it's nuked from the msg base.  But, what
may happen to it downstream is beyond my control.  This is
the same for any email router.  We're lead to have an
expectation of privacy but ... we all know about
expectations.
