If you claim that statement of Ward conflicts with the truth, then you are
essentially calling him a liar.

If you do not know for sure that there was no vote, you admit that there may
have been one.

So why bother?

You did mo such thing. There is no fallacy. You really seem to have no idea
what a theory actually is do you? Let me try to explain. A theory is a set of
presumptions that explains observed phenomena. Theories are not proof. They
come to the mind by intuition, experience and who knows what else.

Theories are confirmed (not proven) by experiments that have an outcome that
was predicted by the theory. Theories are falsified by observations that
contradict the theory. When there is proof, it stops being a theory and becomes
law.

The theory says that when a stone is released it falls down. Releasing another
stone and observing it to fall down confirms the theory. But it is not proof.
The next stone may go up. The theory can be falsified by producing a stone that
goes up. Then the theory has to be dumped or refined to take into account the
stone going up. A good theory fulfils the condition of Falsifiability.
(Popper's requirement)

When there are competing theories that explain the same set of phenomena, the
one that requires the least presumptions is preferred. (Ockham's Razor)
