Ärende: Copyright
=================
RY>> "If American copyrights are valid here through international
RY>> agreements, then Belgian copyrights should also be valid in
RY>> the US of A because of the same international agreements."

 RY>> /That's/ what I don't have a problem with.

BF> To me, that sounds that you advocate some kind of one way lane
 BF> here.

How do you see that? I think they should be equal. Said so, in fact.

RY>> Intellectual achievement comes from many sources some from our
RY>> collective history, some of it truly unique.

BF> ...and none of it is purely your "property". You use intellectual
BF> achievements made by lots of our ancestors, whatever you do. If you
BF> write a book, very little of it is completely new, most of it is just
BF> re-organizing what other authors have written -- whether you are aware
 BF> of it or not.

But as a book, it is unique. the words are borrowed fromthe common langauge,
the thoughts may be refined or accented or put together in new ways, that 's
what makes it unique. Sure there a re common themes, that's why Genre's exist,
but each book is a personal work of the author. as such it is an intellectual
property. Mucxh as inventions are pateneted, which are sometimes, things
redone or used in mew ways, they are ideas. the creator/chaper has the right
to profit from them.

BF> Of course, what you write should be copyrighted to you. The
BF> question is for how long? Today Disney (with the infamous Mickey Mouse
BF> law) has made the US extend copyright to 70 years *after* *you're*
BF> *dead* !?!? I don't know about the US, but here in Sweden your body,
BF> after you've been buried, is protected only 25 years. After that your
BF> remains can be sold as garden soil.

And Berne allows for life plus 50.. what's the difference, 20 years? cannot
the author provide for his heirs?

BF> The copyright laws came about after the printing press was
BF> invented. But today, do you really need protection 70 year (soon to be
 BF> even 90 years) *after* *you've* *died* ? Wouldn't the original 14
BF> years (or was it doubled immediately to 28 years) in the US
BF> Constitution enough? And wouldn't it make better sense to start
BF> counting when the text, or whatever, was released?

Are you saying that Berne should be chagnges as well, with all the trouble
that went into agreeing to it in the first place?

BF> The way the US has taken copyright issues has made you the
 BF> laughing
BF> stock of the world, and the rest of us just love to shove your
BF> stupidity down your throats. Just check out the copyright for the
BF> famous "Happy Birthday To You" song, and find out that you cannot take
BF> your loved ones to a restaurant and expect to sing that famous song,
BF> unless the restaurant has paid tribute to the copyright owners:

 BF> http://www.snopes.com/music/songs/birthday.asp

Yes, that seem silly. however it's no sillier than sueing madonna for a
sampled portion of a song, is it? if the copyright exists, should it not he
honored?
