Yes it does.


When my wife died in 2002, I recieved a Social Security Death benefit
from her SS account. I was working at the time and was required to
pay $1 for every $2 over  certain amount of income I earned.


*I* was making out income tax forms every year, and had to count the
Death Benefit as `income', which was taxable by the IRS after a
certain amount. I never exceeded that amount so I never had to
pay taxes on the extra money.

Plus...*SS* was sending me a statement like a W-2 form at the end of
each year so I could report the income to the IRS.


And you KNOW the IRS was checking with SS each and every year to
see what I'd earned...so it isn't as though SS didn't know what
my income was every year.


When I turned 69 I changed over from the Death Benefit to Social
Security, and low and behold! Social Security quite suddenly
`discovered' that I'd been earning more than the cut-off
amount...and I *owed* several thousand dollars in `back payments'!


I appealed it ( to a `government' official who is supposedly
unbiased!). and when he ruled against me, I appealed it to a
Social Security appeals panel (MORE government officials who
are `un'biased), and lost again! It took almost two years
of partial deductions to finally get my full check. Fortunately
I was still employed and the dollar cut-off amount is far
greater for SS than the Death Benefit. But the dollar cut-off
amount past a certain age (71 or 72) is only for income tax
not any penalty in Social Security check. That ends at age 70,
I think.


The one thing I learned from that was...unless you can afford
a very high-priced lawyer, whatever `case' you are involved
in opposite the federal government...you are going to lose!

It doesn't matter how much you are in the right...or how many
times you appeal...or how much documented evidence you have
to support your claim...without an attorney who has spent
years litigating against the feds...you are going to lose.


And...even WITH the attorney....when you win, you've paid the
attorney so much money in the end, that you might just as
well have gone ahead and paid whatever the government said
you owed and been done with it! `Cause you'd probably be out
more than what you'd have paid to start with.


If the government don't get you....the attorney will!
