Hello Allen,

RC>> Depending on the state, one can detain shoplifters and such, it can
RC>> technically be considered a citizens arrest. It varies though, in most
RC>> states the shoplifter has to advance past the checkouts or even be
RC>> totally outside the door, in other states the act of concealing
 RC>> merchandise is enough.

AP> However -if- they detain you and for some reason they screw up, it's one
AP> hell of a lawsuit and the detainee will profit greatly from it.

Only if the detainee survives. And even then, only maybe.

AP> We have a store here called Meijer and for a time they had an overly
AP> aggressive third shift door greeter lady. She wanted to check EVERYONE's
AP> receipt and literally would go through bags. I suspected it was out of
 AP> boredom.

We are taught that law enforcement is there to "serve and protect."
However, everything that is said can, and will, be used against you.
So what exactly is law enforcement there to "serve and protect"?
Certainly not the individual who is being accused.

AP> This was when was in law enforcement and she tried it with me I asked her
1.
AP> am I being detained. The act of her stopping me to specifically search my
AP> pruchases was detention. Then I reminded her we have constitutional
AP> protection from unnecessary search and seizures. She stood in front of me
AP> and would not let me leave and called the manager.

The boy in Ferguson, Missouri who bought some cheap cigars at a
convenience store was falsely accused of having stolen them. Look
where he is now. Six feet under. Look where the cop who shot him,
in cold blood, is now. Out of a job. And as far away from town as
he can get.

AP> The manager actually defended her by saying "they do it all the time at
Sams
AP> club." I reminded him that "Sams Club" can do it because it's a condition
AP> of membership. Finally I called BS on the mess and showed him my badge
and
AP> said I'm certian that I know what probable cause and resonable suspicion
is
AP> and you have niether so you can't "stop me". They let me go.

The manager of the convenience store finally admitted the boy had
bought the cigars, and not stolen them, when reporters showed up
to question him. Had he told the cops the truth from the beginning,
the boy might still be alive today.

AP> Two days later I'm called to my major's office and I told her what
AP> happened... they poked the wrong bear there as my major got involved
calling
AP> corporate. The "door greeter" disappeared after that and no one has been
AP> stopped other than those who are walking out with a big screen television
or
AP> something similar and then they "remove a security sticker" from the box
AP> which does not make it a search.

I saw a lady try to shoplift a television set by walking it between
her legs. She was a big woman, and was wearing a dress, which hid
the television from view. But her walk kind of gave herself away,
and she got caught in the act as she was walking out the door.

AP> But that's what disturbs me more... even the wal-mart greeters can
sometimes
AP> be overly aggressive. I had one the other day wanting to see my receipt
AP> because I had a box of doughnuts not in a bag. I told him "you don't need
AP> to see my receipt" and continued out the door. Security did not chase
after
AP> me and nothing more was said.

If you want to steal stuff from a department store (such as WalMart),
you have to know how to do it. The first thing you do is get hired.
Doesn't matter what position. Janitor will do. Then, when opportunity
knocks, drop your item of choice in the dumpster outside the store.
After hours, or during your time off, drive up to the dumpster and
retrieve your new toy.

If you do not want to go through the trouble of getting hired, then
make a deal with someone who is already on the inside. Make him/her
an offer he/she cannot refuse. Such as free booze or cigarettes ...

AP> I have to shake my head at those who do stop and let them go through their
AP> purchases. This is how we give up rights... voluntarily in the name of
AP> "security" those doorgreeters have no authority to do this.

If you were a greeter and saw a woman trying to shoplift a tv set
by walking it between her legs, would you make her spread her legs?
You know what would happen next ...

AP> However, sams club and costco do because you signed a membership
agreement.
AP> If you refuse to stop they can't prosecute you... the worse thing that
they
AP> can do to you though is cancel your membership.

Pay $25 for a $3000 tv set? Quite a steal, if you ask me! :)
