 He did not secure warrants, as per FISA statute before executing 
 monitoring of Citizen's communications.  Hell John, he didn't even 
 bother to comply with the 72 hour post wiretap/monitoring provision 
 of the code.  That's the one that says that in the interest of 
 national security and speedy response, the tap/monitoring can be 
 started but a warrant must be submitted to the FISA court within 
 72 hours afterwards.  BUSHCO did not submit to the FISA court, ergo 
 they were in violation of the law, period.

 Actually, congress was not briefed on the program.  A few chairmen 
 of the appropriate committees were given a heads up.  That does not 
 constitute the congress.  Even so, where in the Constituion is it is 
 enumerated that "briefing" congress give the Chief Executive, in his 
 roll as CIC, the power to disregard the law AND the Constitution 
 regarding warrantless searches?
